Terms of Service — Episterra LLC

These Terms of Service ("Terms") govern your access to and use of go-ai (the "Service"), operated by Episterra LLC ("we", "us", "our"). By creating an account, accessing, or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

go-ai is a business productivity platform that provides customer-relationship management (CRM), scheduling, financial/budgeting tools, AI-assisted writing and agents, and communication features (email, LinkedIn, voice, and SMS) for businesses and their authorized users.

2. Eligibility and accounts

  • The Service is a business tool intended for users who are at least 18 years old. It is not directed to children.
  • You are responsible for the activity that occurs under your account and for keeping your credentials secure. Notify us promptly of any unauthorized use.
  • Your workspace administrator may control access, settings, and data within a workspace, and may require multi-factor authentication.

3. Acceptable use

You agree not to use the Service to:

  • violate any law or regulation, or infringe the rights of others;
  • send unlawful, fraudulent, harassing, or deceptive communications, or unsolicited messages in violation of anti-spam, telemarketing, or consumer protection laws (including the TCPA, CAN-SPAM, and applicable state laws);
  • upload malware or attempt to gain unauthorized access to the Service or other accounts; or
  • reverse engineer, resell, or overburden the Service or its infrastructure.

You are solely responsible for obtaining all required consents from the individuals you contact through the Service and for the content of those communications.

4. SMS and messaging program

This section applies to text messages sent to or from numbers operated through the Service, including our toll-free number(s).

  • Consent required. We and our customers send SMS messages only to recipients who have provided prior express consent. Consent is given in one of three ways:

    1. Web opt-in — submitting our opt-in form at go-ai.work/sms-optin.
    2. You text us first — when you send a message to one of our published customer-care numbers, you consent to receive replies from us in that conversation. This consent covers replies about the enquiry you raised; it is not consent to marketing, and we do not add you to any other messaging programme on the strength of it.
    3. An existing business relationship, where permitted by law.

    We retain a record of the consent relied on for each recipient — the consent language agreed to, or the inbound message that opened the conversation.

  • Message types. Messages may include replies to customer-care enquiries you started, account notifications, agent updates, approval requests, and — where a prior business relationship exists — sales and marketing outreach.

  • Frequency. Message frequency varies based on your activity and settings.

  • Cost. Message and data rates may apply, depending on your mobile carrier and plan. We do not charge a fee for the messages themselves.

  • Opt-out. You may opt out at any time by replying STOP to any message. You will receive a single confirmation that you have been unsubscribed and will receive no further messages unless you opt in again.

  • Help. Reply HELP for assistance, or contact support@episterra.ai.

  • Carriers. Mobile carriers are not liable for delayed or undelivered messages.

5. Third-party integrations

The Service integrates with third-party providers (such as Plaid, Calendly, Twilio, Resend, and others) at your direction. Your use of those integrations is also subject to the relevant provider's terms and privacy policy. We are not responsible for third-party services and may add, change, or remove integrations.

6. Your content and data

  • You retain ownership of the data you and your workspace submit to the Service ("Customer Data"). You grant us a limited license to host, process, and transmit Customer Data solely to provide and secure the Service.
  • You are responsible for the accuracy and legality of Customer Data and for having the rights necessary to provide it to us.
  • Our handling of personal and financial information is described in our Privacy Policy.

7. AI features

The Service offers AI-assisted features. AI output may be inaccurate or incomplete; you are responsible for reviewing it before relying on or sending it. Prompt inputs are routed to our AI gateway to generate responses and are not used by us to train models.

8. Fees

Paid plans, if applicable to your workspace, are billed as described at the time of purchase or in a separate order. Fees are non-refundable except where required by law.

9. Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or to protect the Service or other users. On termination, your right to use the Service ends; data handling on closure follows our Privacy Policy.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.

11. Limitation of liability

To the maximum extent permitted by law, Episterra LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising out of or relating to the Service. Our total liability for any claim relating to the Service will not exceed the amounts you paid us for the Service in the twelve months before the claim.

12. Indemnification

You agree to indemnify and hold harmless Episterra LLC from claims, damages, and expenses arising from your Customer Data, your communications sent through the Service, or your violation of these Terms or applicable law.

13. Changes to these Terms

We may update these Terms from time to time. We will post the updated version here and revise the effective date; material changes will be surfaced in the application. Continued use after an update constitutes acceptance.

14. Governing law

These Terms are governed by the laws of the State of Colorado, United States, without regard to its conflict-of-laws rules, and you consent to the exclusive jurisdiction of the state and federal courts located in Colorado.
